Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 3 months, five witnesses have already been examined and the evidence of P.W 6 is in progress is in progress. Learned advocate for the State opposes the prayer for bail. Records reflect that prosecution intends to examine about 13 witnesses in support of its case. Having considered that some more time is required to complete the evidence of the case and the petitioner is detained for a considerable period of time, as such, without entering into the merits of the case, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Biswajit Mondal shall be released 2 on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 2nd Court-cum-learned Special Judge, under POCSO Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial court and shall not leave the district of Nadia without prior permission of the learned trial court.
