ORAL ORDER
Learned counsel for the parties submit that during the pendency of the petition, the elections were held and the results are declared. Learned counsel for the petitioners submits that a liberty be reserved in favour of the petitioners to raise a dispute under Section 70 of the Karnataka Co-operative Societies Act, 1959 (for short 'the Act of 1959') and the counting of the ballot papers of the petitioners shall be subject to the final outcome of the dispute to be raised by the petitioners under Section 70 of the Act of 1959. Hence, prays that the writ petition may be disposed of.
2. Perused the records, and considered the
submissions of the landed counsel for the parties.
3. Admittedly, during the pendency of this petition, this Court vide order dated 11.02.2026 directed respondent no.4 to permit the petitioners to cast their votes in a separate ballot box, and the Returning Officer was directed not to count

the votes of the petitioners, and that the casting of their votes shall be subject to the final outcome of the writ petition, and further, directed the Returning Officer to declare the results of the election.
4. Pursuant to the interim order passed by this Court, the petitioners casted their votes in the election and the Returning Officer has declared the result. In view of the same, nothing survives for consideration in this petition. If the petitioners aggrieved by the result of the election, they have an alternative efficacious remedy under Section 70 of the Act of
1959.
5. In view of the same, nothing survives for further
consideration in this petition. Accordingly, the petition is
disposed of as having rendered infructuous.
6. A liberty is reserved in favour of the petitioners, i.e., if the petitioners are aggrieved by the results of the election, they are entitled to raise a dispute under Section 70 of the Act of 1959, if so advised.

7. In the event, if the petitioners succeed under the dispute raised under Section 70 of the Act of 1959, counting of votes of the petitioners shall be subject to the final outcome of the dispute under Section 70 of the Act of 1959.
8. Sri.Deviprasad Shetty, learned counsel submits that he has filed the impleading application i.e., I.A.No.1/2026 and submits that the impleading applicants may be permitted to participate in the dispute, if raised by the petitioners and with the said observation, I.A. may be disposed of.
9. Submission is placed on record.
10. A liberty is reserved in favour of the impleading applicants to participate in the dispute under Section 70 of the Act of 1959, if raised by the petitioners.
11. Pending applications, if any, shall stand disposed of.
