1. The point involved in the present writ petition is a limited one. 2. Petitioner herein was granted second spell of furlough for a period of two weeks in terms of communication dated 24.07.2026. The abovesaid furlough was on fulfilment of certain conditions. 3. Petitioner complied with the abovesaid conditions and was released from jail on 10.08.2026. He is required to surrender today. 4. The present petition, merely, prays that as per his entitlement, the third spell of furlough for the period of two weeks may also be permitted to be availed in conjunction with the on-going furlough. It is submitted that his mother is not well and, therefore, he seeks the third spell of furlough in conjunction with the existing spell. This is a digitally signed order. 5. Copy of medical document of his mother has been placed on record. 6. Ms. Bhandari, learned counsel for the petitioner submits that mother of the petitioner is in her sixties and is unwell and she had suffered major cardiac arrest in the past also and the petitioner is her only son and, therefore, her request is to grant furlough to petitioner on humanitarian ground. 7. Sh. Rahul Tyagi, learned Additional Standing Counsel for the State appears on advance notice and leaves it to the Court to pass appropriate orders. 8. As already noticed above, Ms. Bhandari, learned counsel for the petitioner has no objection if the request for two weeks is treated as third spell of furlough. 9.
Keeping in mind the overall facts, the petitioner is permitted to avail his third spell of furlough for a period of two weeks, in conjunction with the existing spell of furlough, on the same terms and conditions, as mentioned in earlier communication dated 24.07.2026. 10.
