THE HONOURABLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HONOURABLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION NO: 3393/2025 ORDER: (Per Sri Justice Cheekati Manavendranath Roy)
Heard Sri Sravan Kumar Mannava, the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the official respondents. 2. The petitioner is a Bank, which is a secured creditor. Alleging that the Sale Certificate that is presented, issued in favour of the auction purchaser before the Sub-Registrar is not being registered, the present writ petition has been filed. 3. The learned Government Pleader for Revenue submits that the petitioner did not present the Sale Certificate for registration and as such, the question of refusing to register the Sale Certificate does not arise at all. 4. The petitioner also did not produce any proof to show that the Sub- Registrar has refused to register the Sale Certificate. 5. Therefore, we do not see any valid ground to entertain the writ petition.
Further, the learned Government Pleader for Revenue submits that if Sale Certificate is produced and if it is otherwise in order that the Sub-Registrar will entertain the same for registration. 5
6. Recording the same, the Writ Petition is closed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, including I.A.No.1 of 2026, shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY
