1 | P a g e IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C). No. 14302 of 2026 Subhakanta Pattnaik @ Pattnayak `…. Petitioner Represented by Mr. K.K.Dash, Advocate -Versus - Tahasildar, Bhubaneswar and Ors …. Opposite Parties Represented by Ms. J.Sahoo, ASC CORAM: JUSTICE SASHIKANTA MISHRA ORDER_ 08.05.2026 1. This matter is taken up through hybrid mode. 2. Heard learned counsel for the petitioner and learned Additional Standing counsel for the State. 3. The petitioner has approached this Court with the following prayer: The petitioner therefore prays that Your Lordships may graciously be pleased to consider the facts stated in the writ petition, issue notice to the Opposite Parties as to why the order under Annexure-5 shall not be quashed for improper sanction of law. If the Opposite Parties fail to show cause or show insufficient cause may the Rule absolute and issue a writ of mandamus to set aside the order under Annexure-5, and/or issue such of the writ/writs, direction/directions, order/orders as this Hon’ble Court deem fit and proper on the facts and circumstances of the case. And for this act of your kindness, the petitioner shall as in duty Order No. 01. 2 | P a g e bound ever pray. 4. Perusal of the order sheet of Mutation Case No. 25070 of 2025 reveals that on 20.11.2025, the Revenue Inspector, Sisupal directed issuance of General Notice in Form-9 fixing the case to 20.11.2025, that is, the same day. The matter also appears to have been taken up also on the very same day and held that applicant was unable to produce any endowment permission/recommendation, as the property in question is deity property. Thus, the case record was forwarded to the Additional Tahasildar. By order dated 07.01.2026, the Additional Tahasildar again observed that applicant was unable to produce any endowment permission/recommendation and accordingly, the case was dropped. There is nothing on record to indicate that the petitioner was heard or given opportunity to produce the relevant documents. Moreover, the case being taken up for consideration by the R.I. on 20.11.2025 could not have been posted to the same day. 5. Taking into consideration all these facts, the writ application is disposed of by setting aside the impugned order and directing the Additional Tahasildar to hear the mutation case afresh after granting opportunity of hearing to the petitioner. To cut short the delay, the petitioner is directed to appear before the Additional Tahasildar, Bhubaneswar along with a certified copy of this order on 15.05.2026 at 10.30 a.m. for fixing a further date of hearing.
