Though notice was validly served upon the opp. party no. 2 but no one turns up on behalf of the opp. party no. 2 in spite of repeated calls. This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of CrMP No. 763 of 2025 to its original file. Learned counsel for the petitioners submits that the CrMP No. 763 of 2025 was dismissed for non – prosecution vide order dated 12.03.2026. Learned counsel for the petitioners submits that as the case could not be marked, hence, the advocate for the petitioners could not appear in court when the case was called out, which resulted in dismissal of CrMP No. 763 of 2025. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that CrMP No. 763 of 2025 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the aforesaid submission of the learned counsel for the petitioner, CrMP No. 763 of 2025 is restored to its original file to the stage, at which, it was before its dismissal.
