THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER 1. The petitioners who are accused Nos.1, 2 and 3 are before the Court calling in question registration of a crime in Crime No.0061/2025 by the respondent - Police for the offences punishable under Section 85 read with Section 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and under Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. The complainant has preferred an affidavit before the Court stating that the matter has been settled between the parties before the concerned Court. The affidavit dated 28.11.2025, reads as under: "AFFIDAVIT OF RESPONDENT NO. 2 - 4 - HC-KAR NC: 2026:KHC:9557 CRL.P No. 16460 of 2025 I, Smt. Sindhu K.R., W/o Narasimha Murthy, Aged about 21 years, Residing at No. 11, 3rd Floor, Muneshwara Layout, Near Ganesha Temple, Kadugodi, Bengaluru 560067, do hereby solemnly affirm and state as follows: 1. I am the Respondent No. 2 / Complainant in Crime No. 0061/2025 registered by Whitefield Women Police Station for the alleged offences under Section 85 r/w 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. I am well acquainted with the facts of this case and competent to swear to this affidavit. 2. I state that after filing the above complaint, with the intervention of elders and well-wishers, all disputes between myself and Petitioners 1 to 3 have been amicably settled. The settlement has been arrived at voluntarily and without any force, pressure, coercion, or undue influence from any person. 3. further state that I have no subsisting grievance or complaint against Petitioners 1, 2, and 3. I do not wish to proceed with the allegations in the FIR or the criminal case arising out of Crime No. 0061/2025. 4. I respectfully submit that I have no objection whatsoever for the quashing of the FIR and all - 5 - HC-KAR NC: 2026:KHC:9557 CRL.P No. 16460 of 2025 further proceedings in Crime No. 0061/2025, pending before the jurisdictional court. 5. I also state that both myself and Petitioner No. 1 (my husband) have mutually decided to dissolve the marriage through appropriate legal proceedings before the competent Family Court, and continuation of criminal proceedings would only cause unnecessary hardship to both sides. 6. This affidavit is executed by me out of my own free will, voluntarily, and with full understanding of its contents. In view of the above, I respectfully pray that this Hon'ble Court be pleased to quash the FIR and proceedings arising out of Crime No. 0061/2025, as I have no objection to the same. VERIFICATION I, Smt. Sindhu K.R., the deponent above named, do hereby verify that the contents of paragraphs 1 to 6 are true and correct to the best of my knowledge, information, and belief. Considering the contents of the affidavit as noted above, the FIR registered by the respondent - Police in Crime No.0061/2025 against the petitioners, and all proceedings arising out of Crime No.0061/2025 against the petitioners, are hereby quashed. 4.
