By this petition, the petitioner challenges order dated 05/01/2024, passed by the Chief Executive Officer, M.I.D.C., Mumbai, thereby confirming the cancellation of allotment of Plot No.G-47/5 situated at MIDC, Ahmednagar. 2. The order impugned in present petition is passed in violation of principles of natural justice, as the petitioner was not heard before passing the said order. Also, the same is in contravention of the order dated 20/09/2016, passed by this Court in Review Application No.171/2016, wherein this Court has observed, “5. ….. The Chief Executive Officer is bound to extend an opportunity of hearing to the plot holders against whom he proposes to take action for termination of allotment or resumption of possession of the plots which have been unlawfully allotted/sub-let or transferred in any manner.” SVH 2026:BHC-AUG:47690-DB 2 111-WP-4033-24.odt 3. The impugned order dated 05/01/2024 is, therefore, quashed and set aside and the matter is remanded back to respondent No.2 for consideration afresh on merits.
