[2026:RJ-JP:6180] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 2486/2026 Mohammed Shafi S/o Haji Abdala, R/o Mohalla Vyapariyan, Noor Madarsa Ke Pass, Sadar Masjid Ke Aage, Sikar Through His Power Of Attorney Holder Mohammed Imran S/o Mohammed Shafi, R/o Mohalla Vyapariyan, Noor Madarsa Ke Pass, Sadar Masjid Ke Aage, Sikar. ----Petitioner Versus 1. Aaisha Bano D/o Safiya Bana, W/o Khalid Gori, R/o B- 507, Malkani Hill Road, Opposite Meena International Hotel, Jogeshwari West, Mumbai. 2. Sub Registrar, Sikar 3. State Of Rajasthan, Through Tehsildar Sikar. ----Respondents For Petitioner(s) : Ms. Neetu Bhansali for Mr. Amit Jindal HON'BLE MR. JUSTICE ANUROOP SINGHI Order 10/02/2026 1. Learned counsel for the petitioner has challenged an order dated 14.10.2024 passed by learned Board of Revenue for Rajasthan, Ajmer, in Revision Petition No. 5357/2024, vide which, the interim order dated 19.09.2024 has been recalled. 2. Perusal of order dated 14.10.2024 reveals that the recall of the order dated 19.09.2024 has been made on the solitary ground that the respondents therein had filed a caveat application on 31.07.2024. However, the same was not tagged with the file, as a consequence of which, the matter was heard ex parte on 19.09.2024 and an interim order was passed vide which the order dated 13.11.2021 passed by Deputy Collector and Sub Divisional Officer, Sikar, was stayed. [2026:RJ-JP:6180] (2 of 2) [CW-2486/2026] 3. Learned counsel for the petitioner submits that the order dated 19.09.2024 was passed after duly taking note of the facts on record and the relevant order passed by the Hon’ble High Court, and thus, there was no occasion to recall the same. 4. Learned counsel further submits that after 14.10.2024, the Board of Revenue for Rajasthan, Ajmer, was required to hear the stay application, however, for one reason or the other, till date, the said application is pending and no effective order has been passed thereon. 5. Considering the abovementioned facts and without travelling into the merits of the matter, the present writ petition is disposed of with a limited direction to the learned Board of Revenue for Rajasthan, Ajmer to consider and decide the said stay application filed by the petitioner in Revision Petition No. 5357/2024 titled as Mohammed Shafi versus Aisha Bano, expeditiously, and strictly in accordance with law by passing a speaking and reasoned order, preferably within thirty days from the date of receipt of a certified copy of this order. 6. However, as the said directions have been issued without issuing notices to the respondents, learned Board of Revenue for Rajasthan, Ajmer, shall ensure the service of this order upon the respondents, and the stay application be decided only after granting opportunity of hearing to both the sides. 7. With the aforesaid directions, the present writ petition is disposed of. 8. Pending application(s), if any, also stands disposed of. (ANUROOP SINGHI),J DIPESH CHAYAL /08
