1. The petition is for the following reliefs:
“a) Set aside and/or modify the impugned order passed by the learned Family Court to the limited extent that it failed to adjudicate the Petitioner's specific prayer for award of costs while disposing of the proceedings under Section 125 Cr.P.C. (now Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023); b) Hold and declare that the Respondent abused the process of law by instituting and prosecuting the maintenance proceedings based on false pleadings, deliberate suppression of material facts, concealment of her independent rental income and misleading disclosures made before the learned Family Court; c) Direct the Respondent to reimburse the Petitioner for all litigation expenses incurred by him, including but not limited to counsel's fees, expenses incurred in obtaining bank records, Income Tax documents and other documentary evidence, court expenses and incidental costs incurred in defending the false and frivolous proceedings; d) Impose exemplary and deterrent costs upon the Respondent so as to This is a digitally signed order. discourage abuse of the judicial process and to uphold the sanctity and purity of judicial proceedings, in terms of the law laid down by the Hon'ble Supreme Court;”
2. The Court is not inclined to impose cost against the respondent in view of the statement of the original applicant recorded by the concerned Court. 3. The petitioner, however, is at liberty to take appropriate steps of filing necessary proceedings against the respondent, if the same is permissible in law. 4. With the aforesaid observation, the petition, along with pending application, stands, disposed of. 5. All rights and contentions of the parties are left open.
