By way of the present petition, the Petitioners are seeking quashing of FIR No. 123/2023 registered at Police Station Sonia Vihar, Delhi, for the offences punishable under Sections 324, 341, 506 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 4. Issue notice. The learned APP accepts notice on behalf of the State. Ms. Neha Bisht, learned counsel, accepts notice on behalf of Respondent No. 2. 5. The Petitioners and Respondent No. 2 are present before this Court and have been identified by their respective counsel and the Investigating Officer (‘IO’). 6. The present FIR was registered on the complaint of Respondent No. 2 arising out of an altercation between the parties on 01.03.2023. Upon completion of the investigation, the chargesheet was filed before the learned Trial Court. Vide order dated 12.01.2026, charges under Sections 324, 341, 506(II) and 34 IPC were framed against the Petitioners. Thereafter, on 09.03.2026, at the joint request of the parties, the matter was referred to the Mediation Centre for exploring the possibility of an amicable settlement. 7. The parties subsequently amicably resolved their disputes and entered into a Memorandum of Understanding (‘MOU’) dated 31.07.2026. 8. On a query made by this Court, Respondent No. 2 who has been identified by the IO, has categorically stated that he has entered into the aforesaid settlement vide MOU dated 31.07.2026, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 9. In view of the above, considering that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served by continuing the proceedings rather the same would create further acrimony between them.
It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Accordingly, FIR No. 123/2023 registered at Police Station Sonia Vihar, Delhi, for the offences punishable under Sections 324, 341, 506 and 34 of the IPC, along with all consequential proceedings emanating therefrom, is hereby quashed. 11. The present petition, along with pending application(s), if any, stands
disposed of.
12. A copy of the order be communicated to the learned Trial Court for necessary information and compliance.
