JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned petition is filed seeking the following reliefs: "a) Issue a writ of Certiorari or any other appropriate writ, order or direction quashing the continuation of proceedings in C.P.No.120/BB/2022 on the file of the Hon'ble National Company Law Tribunal, Bengaluru Bench, as being without jurisdiction and non- maintainable in law, as per Annexure-A; - 4 - HC-KAR NC: 2026:KHC:13443 WP No. 6687 of 2026 b) Issue a Writ of Mandamus directing the National Law Tribunal to expedite the proceedings within a time frame. c) Vacate and set aside the interim order of status quo dated 18.11.2022 in C.P.No.120/BB/2022, continuation orders as per Annexure-B; and and subsequent continuation orders as per Annexure-B; and d) Grant such other relief/s as this Hon'ble Court deems fit in the facts and circumstances of the case, including costs, in the interest of justice and equity." 2. Learned Senior counsel while addressing his arguments, did not press the prayer A for the present and restricted himself to seeking indulgence at the hands of this Court to consider prayer B. While doing so, learned Senior counsel has brought to the notice of this Court that out of the three petitions, two petitioners have already withdrawn and in this backdrop, he would try to persuade this Court to issue directions to the National Company Law Tribunal (for short, 'NCLT') to fix the timeline. 3. Though this Court was not inclined initially to fix any timeline while issuing directions, this Court is of the view that in the backdrop of the fact that two of the petitioners have withdrawn their petition, the NCLT may expedite the pending - 5 - HC-KAR NC: 2026:KHC:13443 WP No. 6687 of 2026 petition filed by the petitioner and decide it in accordance with law and shall also make an endeavor to decide the petition within a period of four months.
