Judgment / Order 02/02/2026
1. The present writ petition has been filed challenging the order dated 13.01.2026, passed by the learned Senior Civil Judge, Dausa, District Dausa, in Civil Suit No. 138/2014, whereby the application to summon the witness was rejected solely on the ground that the plaintiff has failed to assign any reasons or purpose for summoning the said witness.
2.
Learned counsel for the petitioner, without pressing the writ petition on merits, has made an innocuous prayer that he may be granted liberty to file a fresh application after disclosing the reasons and purpose for summoning the witness.
3. Considering the same, the writ petition is dismissed as withdrawn. However, the petitioner is granted liberty to file a fresh application to summon the witness with detailed reasons and purpose.
[2026:RJ-JP:4741] (3 of 3) [CW-1888/2026]
4. If such an application is filed, the learned trial Court is expected to decide the same in accordance with the law, without being influenced by the order dated 13.01.2026.
5. If the respondents have any grievance against this order, they are at liberty to file an application to recall the order.
6. Pending application(s), if any, also stands disposed of.
