By the way of the present petition the petitioner is seeking quashing of FIR No. 0956/2023, registered at Police Station DBG Road, District Central, Delhi, for the offences punishable under Sections 288/304-A of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at This is a digitally signed order. between the parties. 4. Issue notice. The learned APP for the state accepts notice on behalf of the State. 5. The petitioner and respondent no. 2 are present before this Court and have been duly identified by their counsel and Investigating Officer (IO). 6. Briefly stated, on 16.11.2023, Parveen @ Golu, while working at an under-construction premises bearing House No. 121, Gali No. 5, Joshi Road, Karol Bagh, Delhi, fell from the third floor and subsequently succumbed to his injuries. Consequently, the aforementioned FIR was registered against the petitioners. Respondent no. 2, father of the deceased, along with his wife Late Smt. Ram Jassi Pasai, also instituted Case No. CEC/18/D/CD/2024 before the Commissioner, Employees’ Compensation, Delhi. During its pendency, his wife expired and respondent no. 2 continued the proceedings. 7. Thereafter, the parties amicably settled their disputes vide Memorandum of Understanding (MoU)/Settlement Deed dated 21.07.2026, whereby the petitioners agreed to pay Rs.4,00,000/- in full and final settlement, comprising Rs.2,00,000/- at the time of withdrawal of the compensation proceedings and Rs.2,00,000/- at the time of quashing of the present FIR. Respondent no.
2 has agreed to cooperate in the quashing proceedings and has no objection to quashing of the FIR and consequential proceedings. 8. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise, vide Settlement Agreement dated 21.07.2026, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. This is a digitally signed order. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion and that no amount is left to be paid, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10. Accordingly, FIR No. 0956/2023, registered at Police Station DBG Road, District Central, Delhi, for the offences punishable under Sections 288/304-A of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed. 11. The present petition is disposed of. 12. Pending application(s), if any, also stand(s) disposed of. 13. A copy of this order be sent to the learned Trial Court for necessary information and compliance. 14. The order be uploaded on the website forthwith.
