(At Present Confined In Central Jail Jaipur). ---Accused-Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Anupam Sharma for Mr. Gajveer Singh Rajawat For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 23/03/2026 1. The present bail application has been filed under Section 482 BNSS in connection with FIR No. 227/2022 registered at Police Station Bekriya District Udaipur for the offence(s) under Sections 419, 420 & 120-B of IPC and Sections 3, 4, 6 & 6(a) of Rajasthan Public Examination (Use of Unfair Means) Act, 1992 and Sections 3, 6, 9 & 10 of Rajasthan Public Examination (Use of Unfair Means) Act, 2022. 2. Learned counsel for the accused-applicant has submitted that the applicant is a young man, aged about 25 years. It is submitted that the impugned order dated 27.02.2026 passed by the learned Trial Court is illegal, contrary to the provisions enshrined under the Code of Criminal Procedure, and not sustainable in the eyes of law. It is submitted that the allegations levelled in the FIR also do not disclose that the accused-applicant [2026:RJ-JP:12036] (2 of 2) [CRLMB-4116/2026] has committed the alleged offence. It is also submitted that the allegations levelled in the FIR are outcome of a concocted story. 3. Per contra, learned Public Prosecutor has opposed the instant bail application. It is submitted that as per settled position of law by the Hon’ble Apex Court in 2014(2) SCC 171 titled State of Madhya Pradesh v Pradeep Sharma and proceedings under Section 82 of Cr.P.C. have been initiated, anticipatory bail should not be considered. It is also a settled position of law that anticipatory bail should be granted in rarest of rare matters, considering the prima facie nature of case. It is also noted that the matter is of public employment and applicant is alleged of unfair practices. 4. Heard and considered. 5. Considering the overall facts and circumstances, this Court is not inclined to allow the anticipatory bail application. 6. Accordingly, the bail application under Section 482 BNSS is dismissed.
