ORDER:
The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus directing the 3rd and 4th respondents police authorities not to interfere in the civil dispute arising out of the MOU Dated 29.07.2024 in the interest of justice otherwise the petitioner will be put to irreparable loss and hard ship the Honble Court may pass such other order(s)….”
2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.
3.
Learned counsel for the petitioners submits that the 1st petitioner has been provisionally selected for the post of District Judge (Entry Level) by this Court in the recruitment process. Taking advantage of the said selection, the de-facto complainant in Crime No. 40 of 2026, namely Sri R. Jaya Prakash, lodged a complaint before the Station House Officer of M.V.P. Police Station, Visakhapatnam. Based on the said complaint, a case was registered. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the petitioners have indulged in acts of deception. Therefore, the police registered the above-mentioned case, and the matter is presently under investigation. 5. Be that as it may, a Memorandum of Understanding (MOU) dated 29.07.2024 was entered into between the petitioners (as the first party) and Sri R. Jaya Prakash (as the second party). As per the terms of the MOU, the petitioners agreed to retain 60% of the scheduled properties, leaving the
3
remaining 40% share to the second party. The said MOU was executed to safeguard certain properties of the petitioners. 6. As stated supra, the relief sought in the present writ petition is limited to a direction to respondent Nos. 3 and 4 not to interfere in the civil dispute arising out of the MOU dated 29.07.2024. A photocopy of the MOU has been filed on record. Under the MOU, the petitioners are the first party and the de- facto complainant in Crime No. 40 of 2026 is the second party. The MOU sets out various liabilities, obligations, rights, and privileges of the parties. On the face of it, the dispute arising out of the MOU is civil in nature. It is alleged that respondent Nos. 3 and 4 are interfering in the civil dispute pending between the petitioners and the second party to the MOU. 7. In that view of the matter, there shall be a direction to respondent Nos. 3 and 4 not to interfere with the civil dispute between the petitioners and the second party to the MOU dated 29.07.2024 with regard to the civil liabilities mentioned therein. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. However, it is made clear that respondent Nos.
3 and 4 are at liberty to proceed in accordance with law in FIR No. 40 of 2026, initiated at the instance of the second party to the MOU. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y. LAKSHMANA RAO, J. Date: 16.02.2026 KMS
