The petitioner is apprehending his arrest in connection with Mandu P.S. Case No. 145 of 2025 (NDPS Case), registered for the offence under Sections 15(C), 18(b), 25 and 29 of the NDPS Act, pending in the court of learned Sessions Judge, Ramgarh. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the name of the petitioner has come only on the basis of confessional statement of the apprehended co-accused. She next submits that false allegation is made against this petitioner that this petitioner has instructed the owner-cum-driver and assistant of the vehicle to send 128.7 kgs doda in the State of Punjab. On these grounds, she submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner is the mastermind and the apprehended owner-cum-driver and assistant of the truck in question, have taken the name of this petitioner, saying that this petitioner has arranged the said doda for carrying the same to the State of Punjab and [2026:JHHC:17225] -2- assured that he will take care of the said doda in the State of Punjab. He then submits that the quantity of the recovered doda is commercial. On these grounds, he submits that anticipatory bail may kindly be rejected. 5. Two of the apprehended co-accused, who are owner-cum- driver and assistant of the truck in question have taken the name of this petitioner saying that this petitioner has instructed them to carry the doda in question to the State of Punjab and assured that he will take care of the said doda, prima facie it appears that this petitioner is the mastermind and on whose instruction, the said contraband was being carried. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, above named. Accordingly, his prayer for anticipatory bail is rejected.
