Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Petitioner is a retired employee of Calcutta State Transport Corporation (for short, ‘Corporation’), who retired on superannuation on 31st July, 2020. Petitioner has prayed for consolidation of leave encashment benefits based on calculation of 300 days, not 180 days, in terms of Clause IX of memo dated 17th September, 2009 issued by the Joint Secretary to the Government of West Bengal, Transport Department. 3. Corporation and State respondents are represented by learned advocates. 4. Having considered the respective submissions made on behalf of the parties, Court finds no purpose 2 would be sub-served in keeping this writ petition pending. 5. Leave is granted to the petitioner to make a representation claiming leave encashment benefits for a period of 300 days, not 180 days to the Managing Director, Calcutta State Transport Corporation being respondent no.5 by fortnight from date. If representation is made to the respondent no.5 within the aforesaid time, decision shall be taken by the respondent no.5, in accordance with law, by twelve (12) weeks thereafter. 6. Respondent no.5 shall pass a reasoned order and same shall be communicated to the petitioner by ten (10) days thereafter. 7. In the event decision is taken to enhance leave encashment benefits, consequential steps shall be taken by the concerned respondent authorities for releasing same to the petitioner. 8. With the above directions, writ petition stands disposed of. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
