HON'BLE MR. JUSTICE JASMEET SINGH O R D E R % 19.08.2026

“(a) a Civil Writ of Certiorari under Article 226 of the Constitution of India seeking quashing of the Refusal Order dated 24.01.2026 issued by the Respondent No.2, whereby it has refused the application Dated 04.10.2025 of the Petitioner Institution submitted for seeking transition of its B.A. B.Ed. / B.Sc. 08.07.2026 issued by the Appeal Committee of the Respondent No.1, whereby it has rejected the Statutory Appeal of the Petitioner Institution, thereby confirming the aforesaid Refusal Order dated 24.01.2026 issued by the Respondent No.2; without deliberating upon documents submitted by Petitioner Institution, in support of its appeal; and (c) a Civil Writ of Mandamus under Article 226 of the Constitution of India for seeking direction to the Respondent No.2 to conduct inspection of the Petitioner Institution and to decide its application dated 04.10.2025 for transition of its B.A. B.Ed./B.Sc. B.Ed. course to the Integrated Teacher Education Programme, from ensuing Academic Session; expeditiously and preferably within a period of 1 week; …”
2. For the reasons stated in the petition, issue notice. 3. Mr. Kapoor, learned counsel, accepts notice on behalf of the respondents and has addressed arguments. 4. The petitioner is an institution running the B.A. B.Ed. / B.Sc. B.Ed. course since 2018. The application for transition filed by the petitioner has been rejected by the Northern Regional Committee (“NRC”) as well as the Appeal Committee. 5.
The only reason for rejecting the case of the petitioner is contained in the Order dated 08.07.2026 at page No. 44, wherein it reads as under:
“i) The institution has failed to establish compliance with the mandatory land and infrastructure requirements prescribed under the NCTE Act, 1993 and the NCTE (Recognition This is a digitally signed order. Norms and Procedure) Regulations, 2014 (as amended). The institution's own submissions establish that the Building Completion Certificate and Building Safety Certificate relied upon by it have been issued/attested by the Gram Panchayat/Sarpanch. Such documents do not satisfy the mandatory requirement of certification by the competent Government Engineer/Local Authority in the prescribed NCTE format and, therefore, cannot be accepted as valid statutory evidence of compliance. Reliance upon past practice, previous acceptance, local administrative procedure or post facto explanations cannot override the mandatory statutory and regulatory requirements governing recognition.”
6. The Appeal Committee was of the view that the Building Completion Certificate and the Building Safety Certificate was only issued / attested by the Gram Panchayat / Sarpanch. 7. However, a perusal of the Building Completion Certificate, annexed as Annexures P-14 and P-15, shows that in addition to the attestation by the Sarpanch, it has also been attested by a registered architect as well as the Sub Divisional Engineer, Provincial Sub Division No. 1, PWD B&R Br., Jind. 8. Hence, the impugned order suffers from factual mistakes. 9. Consequently, the appeal order dated 08.07.2026 and the refusal order dated 24.01.2026 are set aside and the Northern Regional Committee (“NRC”) will consider the case of the petitioner afresh in view of Building Completion Certificate dated 14.12.2006 and letter dated This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
