After long drawn arguments, learned counsel for the petitioner restricted his prayer to direct the respondents to consider his complaint dated 05.03.2018 made to the Collector. 5. It has also come on record the grievance of the petitioner is about allotment of the plot no. 70 from survey nos. 3 and 4 situated at Paithan in favour of the respondent no. 5. It is his case that being a project affected person, he is entitled to get a plot by the Government. It is further the case that he is already residing on plot no. 70 and, 2026:BHC-AUG:47045-DB 2 WP / 8169 / 2018 therefore, it should be allotted to him by cancelling the allotment in favour of the respondent no. 5. However, this Court has seen from the record that already petitioner has filed Regular Civil Suit No. 74 of 2002 in the Court of learned Joint Civil Judge Senior Division, Aurangabad seeking allotment of plot no. 70. 6. The civil Court by judgment dated 28.08.2003 clearly recorded a finding that the plaintiff has not produced any document to prove that he is in possession of plot no. 70. The Court, however, held the entitlement of the petitioner is to get the land allotted by the Government, however, no particular land, as claimed by the petitioner. 7. Be it as it is. If the petitioner is entitled and eligible to get the plot as project affected person, the land authorities shall consider the same. The authorities also to consider the compliant / representation dated 05.03.2018 Exhibit – E (page 35 of the petition) within a period of eight weeks from today on its own merits and in accordance with law, if not already decided. 8.
