JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in C.C.No.5069/2025, pending before the IV Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for offences punishable under Sections 318(4), 316(2), 352, 351(2), 3(5) of the BNS, 2023. 2. Learned counsel for the petitioner – accused and respondent No.2 – complainant in unison submit that during - 3 - HC-KAR NC: 2026:KHC:13938 CRL.P No. 12804 of 2025 the pendency of these proceedings, the parties to the lis have settled their disputes amicably by drawing up certain terms and conditions. The parties to the lis have filed an application under Sections 320 r/w. 482 of the Cr.P.C., along with joint verifying affidavit seeking permission to compound the offences before this Court to that effect. 3. The application reads as follows: “3. Due to the intervention of the family members and well-wishers of the petitioners and the respondent No.2, both parties have sought out their difference and resolved their dispute amicably. Accordingly, the petitioners and the respondent No.2 agreed to close the criminal case which is filed by the respondent No.2. 4. The petitioner No.1 is the relative of the respondent No.2 and petitioner No. 2 is the friend of the petitioner No.1 and both petitioners have not involved in the said alleged offence. Hence, the respondent No. 2 agreed to settle the matter amicably against these petitioners and also agreed to co-operate to close or quash the proceedings against the petitioners in C.C. No. 5069/2025 filed by Respondent No.1 / Basaveshwara Nagara Police station for the commission of the alleged offences under Sections 323, 406, 420, 506 R/w 34 of 1.P.C on the file of the IV Additional Chief Judicial Magistrate At Bengaluru. Hence this application seeking quash the proceedings in C.C. No. 5069/2025 against the petitioners in the present petition before this Hon'ble Court and the said offences are compoundable in nature. 5. The petitioners and the respondent No.2 jointly and voluntarily with due consent filing this application to - 4 - HC-KAR NC: 2026:KHC:13938 CRL.P No. 12804 of 2025 quash the entire proceedings in C.C. No. 5069/2025 filed by Respondent No.1 / Basaveshwara Nagara Police station for The commission of the alleged offences under Sections 323, 406, 420, 506 R/w 34 of I.P.C on the file of the IV Additional Chief Judicial Magistrate At Bengaluru against the petitioners. Wherefore, the petitioners and the respondent No.2 humbly prays to this Hon'ble Court to quash the entire proceedings C.C. No. 5069/2025 filed by Respondent No.1 / Basaveshwara Nagara Police station for the commission of the alleged offences under Sections 323, 406, 420, 506 R/w 34 of I.P.C on the file of the IV Additional Chief Judicial Magistrate At Bengaluru against the petitioners / Accused No. 2 & 5, in the interest of justice.” Though the offence alleged against the petitioner in the case at hand inter alia is the one punishable under Section 506 of the IPC, which is non-cognizable, since the complainant and the petitioner have resolved the dispute amicably amongst themselves and as the allegations are not against the State, I deem it appropriate to accept the application and the joint verifying affidavit of the parties and terminate the proceedings against the petitioner. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. - 5 - HC-KAR NC: 2026:KHC:13938 CRL.P No. 12804 of 2025 (ii) The proceedings in C.C.No.5069/2025, pending before the IV Additional Chief Judicial Magistrate, Mayohall, Bengaluru, qua the petitioner, stand quashed.
