( 2026:JHHC:17266 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 2831 of 2026
------ Md. Sarfaraz @ Md. Qurban @ Sarfaraj @ Sarfaraz, aged about 23 years, s/o Nek Mohammad, r/o Near Gausul Wara Masjid, Nezam Nagar, P.O.-G.P.O., P.S.-Hindpiri, Dist.- Ranchi, Jharkhand
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Rahul Pandey, Advocate For the State
: Mr. Arun Kr. Dey, Addl. P.P. ------
Order No.04 Dated- 15.06.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. No. 147 of 2024 arising out of Kotwali P.S. Case No.191 of 2023 (G.R. No. 2204 of 2023) registered for the offences punishable under sections 307/324/394 of the Indian Penal Code and under Section 25(1-B)a/26/27 of Arms Act.
This is the fourth journey of the petitioner with the prayer for regular bail. The learned counsel for the petitioner submits that the fresh ground is that on the date of rejection of the earlier bail application on 26.09.2025, the injured victim was examined as P.W.5 and he has supported the case of the prosecution and beside him, P.W.6 has also been examined and he has also supported the case of the prosecution. It is further submitted that the allegations against the petitioner are all false. It is then submitted that the petitioner has been in custody since 13.06.2023, as has been mentioned in paragraph no. 01 of the bail application. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the serious nature of allegation against the petitioner as well as the fact that the witnesses of the prosecution including the victim has
categorically stated against the petitioner that the petitioner attempted to commit murder by firing upon the chest the victim; there is every chance of the petitioner absconding and tampering with evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner and the evidence that has already come on record against the petitioner by way of the examination of the prosecution witnesses so far, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail. Accordingly, the prayer for bail of the abovenamed petitioner is rejected.
