Respondent(s) For Petitioner(s) : Mr. Anuroop Panda, Advocate For Respondent(s) : Mr. Raghvendra Pradhan, Advocate MANPREET KAUR Digitally signed by MANPREET KAUR Date: 2026.01.31 17:35:08 +0530 2 Hon'ble Shri Ramesh Sinha, Chief Justice Hon'ble Shri Ravindra Kumar Agrawal , Judge Order on Board Per Ramesh Sinha , Chief Justice 31.01.2026 1. Heard Mr. Anuroop Panda, learned counsel for the petitioner as well as Mr. Raghvendra Pradhan, learned counsel for respondent. 2. The present writ petition has been filed by the petitioner for following relief: “i. That, this Hon'ble Court may kindly be pleased to quash the impugned order dated 12/4/2022 (Annexure P/1) bearing No.409/CGMSC Ltd./Tech./2022 passed by the respondent No.2. ii. Cost of the petition may also be granted to the petitioner. iii. Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 3. It has been pointed out by learned counsel, appearing for the petitioner as well as learned counsel appearing for the respondent that in an identical matter, this Bench had dismissed WPC No. 5477/2021 (Rusan Pharma Ltd. Vs. State of Chhattisgarh and Another) vide order dated 14.01.2026, observing as follows : “10. From perusal of the order dated 21.10.2021 (Annexure P/1) passed by the respondent No. 2, it transpires that the petitioner was blacklisted for a period of three years which has already come to an 3 end and as such, the issue of blacklisting has become academic and no fruitful purpose would be served if it is adjudicated upon and virtually, the petition has become infructuous. 11. Now, after expiry of three years, the petitioner can very well participate in any tender proceedings floated by the Government or its instrumentalities and as such, this petition is dismissed as having become infructuous. So far as the issue of refund of the EMD amount is concerned, the petitioner may take recourse to law, if any, available to him.” They further submit that since the facts and issue involved in the present case is similar to that of WPC No. 5477/2021, this petition may also be dismissed in the same terms. 4. Having considered the rival submissions made by learned counsel for the parties and having gone through the materials on record, it is evident that the facts and issue involved in this petition is similar to WPC No. 5477/2021, this Court deems it appropriate not to take a view other than what has been taken in WPC No. 5477/2021. 5. Accordingly, the present appeal is dismissed in terms of the order dated 14.01.2026 passed in WPC No. 5477/2021. Sd/- Sd/- (Ravindra Kumar Agrawal) (Ramesh Sinha) Judge Chief Justice Manpreet
