The learned Advocate for the applicants submits that offence mainly arises due to a dispute between the husband and wife in which the allegations pertaining to commissioning of the present offence is levelled against the present applicants. Without getting into the merits of the matter, he submits that the present applicant Criminal Application Nos. 2999/2026, who happens to be husband of the informant, and the informant have compromised the dispute among themselves. Even other applicants are party to the said compromises. The main compromise pertains to the settlement between the husband and wife. As the dispute has been amicably resolved, they seek quashment of the offence against all the applicants/accused. 4. This Court, had directed the parties to appear before the learned Registrar (Judicial) for the purpose of verification of their credentials as well as the compromise terms. The report is submitted by the learned Registrar stating that the parties have settled the dispute among themselves. The report also carries a copy of affidavit in support of compromise and quashing of the FIR. Perusal of the said affidavit of compromise shows that the parties have settled the dispute amicably between themselves. Mainly it is submitted that the dispute between the husband and the informant-wife which is purely a matrimonial discord and arose due to misunderstanding has been settled by intervention of family members and well wishers. The husband and 2 of 4 140appln2999-26 wife are presently residing together at Pune happily. The reconciliation has taken place and therefore, there remains no dispute or grievance between both of them. 5. In terms of the settlement between the husband and wife, they are residing with each other. The settlement terms states that the informant does not wish to proceed with the criminal prosecution against the applicants and she has given full and free consent for quashing the entire proceedings against the applicants. 6. I have perused the compromise terms which narrates as above. As the matrimonial dispute between the husband and wife has been resolved and the applicant Rajat and the informant wife are residing happily together in their promotional life, the consent given by the informant can be considered. I am of the opinion that on he basis of amicable settlement between the parties, the entire offence and the criminal proceeding can be quashed.
