THE HONOURABLE SRI JUSTICE SUBHENDU SAMANTA CIVIL REVISION PETITION NO: 456/2020 O R D E R:
1. Instant Civil Revision Petition has been preferred against an order dated 20.12.2019 in I.A.No.366 of 2019 arising out of O.S.No.7 of 2017 passed by the learned Junior Civil Judge –cum- Judicial Magistrate of I Class, Pakala. 2. Brief fact of the matter is that:- a suit was filed vide O.S.No.7 of 2017 for permanent injunction. One application was made vide I.A.no.366 of 2019 in the said suit for amendment of cause title of the said Plaint. Learned Court below after hearing the parties, has allowed the prayer under the provision Order VI, Rule 17 read with Section 151 of Civil Procedure Code. The plaintiff being aggrieved by that Order filed the instant Civil Revision Petition. 3.
Heard the learned Counsel for the Petitioner/Plaintiff. 4. It appears from the impugned Order that the learned Court below has heard the parties at length and after hearing the parties, he passed the impugned order. I have perused the impugned Order. It appears that the impugned Order suffers no illegality or impropriety. Moreover, the proposed amendment is formal in nature and shall not change the nature and character of the suit. The learned Court below has also find that the issue of jurisdiction can be decided separately by framing an issue therein at the time of Trial. I find no illegality or impropriety in the observation of the learned Trial Court. Accordingly, the instant Civil Revision Petition is dismissed. 4
The learned Court below is directed to dispose of the Suit according to the provisions of the Law as early as possible, most preferably within four (04) months, from the date of passing of this order. 5. In the result, the Civil Revision Petition is dismissed, without costs. Consequently, pending miscellaneous applications, if any, shall stand closed. ___________________________ JUSTICE SUBHENDU SAMANTA KS Dated:06.01.2026. 5
