…...... 02/ 16.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 147, 148, 149, 323, 341, 325, 385 & 387 of IPC, under Sections 17(1)(2) of C.L.A. Act.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned A.P.P. opposes the prayer for bail.
4. It is alleged that 20 to 25 extremists came to the work place of the informant for stopping the work. They started assaulting the labourers and took away their mobile phones.
5. Petitioner is not named in the F.I.R. Nothing has been recovered from the possession of this petitioner. Though there are five antecedents, but surprisingly the chargesheet has been submitted without putting the petitioner in TIP.
6. Considering the nature of the allegation, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is
directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Chatra, in connection with Simariya P.S. Case No.96 of 2019, subject to the condition that one of the bailors should be a close relative of the petitioner, having
sufficient landed property in his own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Chatra once in a month till the disposal of the trial.
