1. Learned counsel appearing on behalf of the petitioner submits as follows. On 9.3.2025 two trucks collided. One of the trucks, which was filled with stone chips, was taken to the police station. Next day, allegedly the police received information that the other truck which was lying abandoned contained a huge quantity of contraband. Nobody was arrested from the spot. The only materials available against the petitioner is the statement of a co- accused.
2. Learned counsel appearing for the State files a report, which is taken on record. He opposes the prayer for anticipatory bail. He relies on the case diary and submits that one of the principal accused was arrested and his wife was the owner of the truck. There were 161 calls made between the said accused and the present

petitioner between 01.02.2025 and 08.03.2025. The present petitioner was the driver of the truck. Reliance is also placed on another witness who saw him flee away from the place of occurrence.
3. Considering the above and the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
4. Accordingly, the application for anticipatory bail is rejected.
