Case No. 19 of 2024 (S.T. No. 109 of 2024, G.R. No. 242 of 2024) for the offence registered under Sections 399, 400, 402, 412 of the Indian Penal Code and Section 25(1-B)(a), 26(2) and 35 of the Arms Act, pending in the court of Additional Sessions Judge-II, Latehar. It is submitted by learned counsel for the petitioner that no offence under the Arms Act will be made out against the petitioner in the present case as he was not present at the place of occurrence. Nothing was seized from the petitioner’s possession and his name has come up on the basis of the confessional statement of the co-accused. The petitioner is languishing in custody since 16.02.2024. Learned counsel for the State has opposed the prayer for bail. Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
