This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under sections 318(4), 319(2), 338, 340(2), 61(2) of BNS and under section 66(C), 66(D) of I.T. Act.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. On 23.12.2025 the police received secret information that some persons were conducting cyber-crime activities from Maa Shanti Guest House. During a raid, four persons, including the petitioner, were apprehended and several mobile phones and SIM cards were recovered from them. The police claim that the phones contained WhatsApp chats relating to money transactions, bank account details, suspicious URLs, and APK files allegedly used for cyber-crime. Based on these allegations, the FIR was registered and the accused were arrested.
4.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated. He further submits that there is no allegation that the mobile phones recovered from the petitioner are in any way connected with cyber-crime or has been used to cheat anyone. He also submits that the petitioner

has no criminal antecedents and there is no independent witness to the seizure list and both the witnesses are police personnel only which creates doubt on the prosecution case itself.
5.
Learned counsel for the state opposes the prayer for bail.
6. After hearing the parties and after going through the record, I find that the petitioner has been in judicial custody since
23.12.2025. The allegation regarding use of mobile numbers in cyber fraud is primarily against the co-accused, whereas there is no specific material on record showing that the mobile phones allegedly recovered from the petitioner were used for commission of the alleged cyber offences. The petitioner is stated to have no criminal antecedents.
7. Considering the aforesaid facts, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is
directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl.
