This application is directed against the judgment dated 12.01.2026 passed in Cr. Appeal No. 59 of 2025 by the learned Special Judge, Children’s Court, Sahibganj whereby and whereunder the appeal preferred by the petitioner against the order dated 26.08.2025 passed in Rajmahal P. S. Case No. 211 of 2025 by the learned Principal Judge, Juvenile Justice Board, Sahibganj rejecting the prayer for bail of the petitioner has been affirmed. It has been alleged that the nephew of the informant had been murdered by some named accused persons including the petitioner. Submission has been advanced by the learned counsel for the petitioner that though the petitioner has been named in the FIR, but admittedly there is no eye-witness to the incident. It has further been submitted that one Samir Rajak is alleged to have disclosed about the incident to villagers including the informant. He has also submitted that the statement of Samir Rajak has not been recorded during investigation. Learned counsel for the petitioner adds that the petitioner is in custody since 24.06.2025. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner. -2- It appears from the statement of the witnesses that it was Samir Rajak who had informed about the involvement of the petitioner in commission of murder. It further appears from paragraph 61 of the case diary that one Rajesh Kumar Yadav had seen the incident and the boys present there had disclosed that it was the present petitioner who had committed assault upon the deceased with a knife. However, nor the said Samir Rajak has been examined nor the boys who have purportedly disclosed about the murder to Rajesh Kumar Yadav have been examined. The appellant seems to have been implicated primarily on account of the confessional statement as well as disclosure about the involvement of the petitioner in commission of murder to some other witnesses by Samir Rajak. On consideration of the aforesaid facts, order dated 12.01.2026 passed in Cr. Appeal No. 59 of 2025 by the learned Special Judge, Children’s Court, Sahibganj and the order dated 26.08.2025 passed in Rajmahal P. S. Case No. 211 of 2025 by the learned Principal Judge, Juvenile Justice Board, Sahibganj are set aside and the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Principal Judge, Juvenile Justice Board, Sahibganj in connection with Rajmahal P. S. Case No. 211 of 2025, subject to the condition that the father of the petitioner shall ensure the welfare of the petitioner and shall further ensure that he is kept away from anti- social elements.
