JUSTICE P SREE SUDHA ORAL ORDER Heard the arguments of the learned counsel for the petitioner and the learned counsel for the respondent. 2. This Civil Petition is filed by the petitioner/wife for transfer of MC.No.53/2025, filed by the respondent/husband for divorce, from the Family Court at Davangere to the Principal Family Court at Bengaluru. - 3 - HC-KAR NC: 2026:KHC:22003 CP No. 93 of 2026 3. It is stated that the petitioner is residing in Bengaluru and is working in a private company. Hence, she requested for transfer of the said case to the Principal Family Court at Bengaluru. The marriage between the petitioner and the respondent was solemnized in the year 2021 and they are not having any children. It is further stated that the petitioner is suffering from health issues and has filed a medical certificate to show that she is suffering from diabetes and hormonal changes and thus she is unable to travel a distance of 263 kilometres from Bengaluru to Davangere. 4. In the objections filed by the respondent, it is stated that he is also working in a private company at Davangere and is taking care of his parents. It is further stated that the petitioner was suffering from mental illness and diabetes and is taking constant treatment and is on medication. She also attempted to commit suicide in January, 2024. The respondent mainly contended that the - 4 - HC-KAR NC: 2026:KHC:22003 CP No. 93 of 2026 petitioner suppressed her medical condition at the time of the marriage. 5. Admittedly, the petitioner is having health issues and the distance between Bengaluru and Davangere is 263 kilometers. Therefore, this Court finds it just and reasonable to transfer MC.No.53/2025 from Family Court, Davangere to the Principal Family Court at Bengaluru. 6. The respondent is at liberty to file his chief affidavit and he can be cross-examined either through a Commissioner or through video conferencing facility. 7. The Family Court is specifically directed not to insist upon the personal appearance of the respondent unless there is any requirement. 8.
