The petitioner is aiming to stretch his destitute wife to legal proceedings by invoking the supervisory jurisdiction of this Court under article 227 of the Constitution of India by calling in question an order dated 17.04.2026 passed by the Principal Judge, Family Court, Srinagar whereby said Court has admitted the respondent to monthly maintenance of Rs. 5000/- on account of proceedings initiated under section 144 of Bharatiya Nagarik Suraksha Sanhita, (BNSS) 2023. 02. The respondent is said to have also invoked the proceedings under the Protection of Women from Domestic Violence Act, wherein she has been admitted to monthly maintenance of Rs. 3000/- per month. Thus, aggregating monthly maintenance payable to the respondent to be Rs. 8000/-, the maintenance amount in favour of his spouse alleging neglect 121 Suppl-I from her husband, by no stretch of imagination can be said to be on the higher side so as not to be affordable by the husband to be paid to the wife. As such, this Court does not find any reason to entertain the present petition and hence the same is dismissed. 03. Copy of this order be forwarded to the Principal Judge, Family Court, Srinagar for the sake of being taken on record. 04.
