The present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant seeking anticipatory bail in FIR No. 139/2026 dated 24.05.2026, registered at P.S. Gokalpuri for the offences punishable under Sections 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’). 3. Briefly stated, the concerned allegations involve the complainant and his friend being assaulted with iron rods, spanners and sticks by persons who were calling one another “Tinku”, “Titu” and “Sandeep”. The applicant denies his presence at the spot, relies upon CCTV footage and claims that the aforementioned FIR is a counterblast to the complaint lodged by his maternal aunt. Vide order dated 12.06.2026, the applicant was granted interim protection, which was continued further vide order dated 10.07.2026, with a direction to provide the complete CCTV footage to the Investigating Officer (IO). 5. Learned APP for the State has handed over the Status Report in court today. Let the same be taken on record. 6. Learned APP for the State, based on information received from the Investigating Officer (IO), submits that the CCTV footage covering a period of 24 hours has been furnished by the applicant and, upon analysis thereof, he further concedes that the applicant was present at his residence at the relevant time. 7. Considering the aforesaid submission, and the fact that the applicant has joined the investigation and his custodial interrogation is not required, the present application is allowed. Accordingly, in the event of arrest, the applicant shall be released on anticipatory bail upon furnishing a bail bond to the sum of ₹25,000/- with a surety of the like amount, to the satisfaction of the concerned Station House Officer (SHO) / IO, subject to the following conditions: i) The Applicant shall remain available on mobile numbers; shared by him with the Police. ii) The Applicant shall not leave NCT of Delhi without prior permission of the concerned IO/SHO. iii) The Applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner. iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO.
