2 SRS, J W.P.No.3075 of 2023
2. Mattegunta.Sudhir,Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats The Court made the following order: Heard Sri N.Premraj, learned counsel for the petitioner, Ms. P.Usha, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4, Ms. Kavitha, learned Counsel representing Sri M.Sudhir, learned Standing Counsel for the 5th respondent.
2.
Learned counsel for the petitioner would submit that the petitioner is the absolute owner of an extent of Ac.5.47 cents in Sy.No.116-3, Ac.5.00 cents in Sy.No.116-4, and Ac.0.90 cents in Sy.No.116-5, A.Narayanapuram Village, Ananthapuramu Mandal, Ananthapuramu District. The petitioner purchased Ac.5.47 cents in Sy.No.116-3 and Ac.5.00 cents in Sy.No.116-4 on 29.01.2003 & 11.03.2003, respectively. The Pattadar Passbook issued by the revenue authorities, in respect of Ac.5.47 cents and Ac.5.00 cents was filed. However, in respect of Ac.0.90 cents in Sy.No.116-5, no document was filed.
Learned counsel for the petitioner would submit that the vendors of the petitioner continued in possession of Ac.0.90 cents and thereafter, the petitioner continued in possession of the property.
3.
Learned counsel would fairly submit that no documents are available in respect of Ac.0.90 cents in Sy.No.116-5. Learned counsel would contend that the 5th respondent is interfering with the petitioner’s possession and enjoyment of Ac.5.47 cents in Sy.No.116-3, Ac.5.00 cents in Sy.No.116-4, and Ac.0.90 cents in Sy.No.116-5 without issuing any notice.
3 SRS, J W.P.No.3075 of 2023
4. Ms. Kavitha, learned counsel representing Sri M.Sudhir, learned Standing Counsel for the 5th respondent, submitted written instructions received from the 5th respondent, the Panchayat Secretary. As seen from the written instructions, an extent of Ac.0.90 cents in Sy.No.116-5 is described as
“Migulu Bhoomi”, and the said land was not assigned to any individual. It was mentioned as Government land in the revenue records. The petitioner is not a landless poor person. As per the instructions of the District Administration, the extent of Ac.0.90 cents in Sy.No.116-5 has been identified for the establishment of an Electric Sub-Station. So far, no proposal for alienation of the said land has been submitted to the office of the 5th respondent. If any such proposal is submitted, the 5th respondent will take necessary action in accordance with the law.
5. The instructions further indicate that there is no proposal at present for the construction of drainage in Ac.0.90 cents in Sy.No.116-5. It is also stated that the petitioner has encroached on the said land by planting trees, and the respondent authorities will take necessary steps to remove the encroachment.
6. Thus, as seen from the averments in the writ petition coupled with the written instructions, it is clear that the petitioner got title over an extent of Ac.5.47 cents in Sy.No.116-3 and Ac.5.00 cents in Sy.No.116-4 of A.Narayanapuram Village, Ananthapuramu District. In respect of Ac.0.90 cents in Sy.No.116-5, the petitioner did not file any documents. The instructions indicate that Ac.0.90 cents in Sy.No.116-5 is Government land,
4 SRS, J W.P.No.3075 of 2023
and that the petitioner occupied the said land, and necessary steps will be taken for removal of the encroachment.
7. Given the facts and circumstances of the case, the Writ Petition is
disposed of, directing the 5th respondent not to interfere with the petitioner’s possession and enjoyment of Ac.5.47 cents in Sy.No.116-3 and Ac.5.00 cents in Sy.No.116-4. However, in respect of Ac.0.90 cents in Sy.No.116-5, situated at A.Narayanapuram Village, Ananthapuramu District, the Secretary of the 5th respondent is at liberty to take necessary steps strictly in accordance with law. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
