JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:13520 WP No. 23798 of 2021 ORAL ORDER The present writ petition is filed seeking the following prayer: “Wherefore the petitioner respectfully prays that this Hon’ble Court may be pleased to: [a] Issue a writ in the nature of Mandamus directing the Respondent - Bank to not to proceed further with any action against the scheduled property per ANNEXURE - 'F', dated 28.09.2021 and Annexure - "L" dated 16.12.2021. [b] Issue a writ in the nature of Mandamus directing the Debt Recovery Tribunal at Bangalore to kindly consider the I.A No 2820/2021 filed by the petitioner which is annexed as per ANNEXURE - K. [c] Issue a writ in the nature of Mandamus directing the Respondent - Bank, consider the Representation letter dated 15.10.2021, which is annexed as per ANNEXURE - F. [d] Issue directions to the Respondent - Bank, pending the disposal of the Writ Petition, not to proceed further with any action against the scheduled property of Petitioner." 2. When the matter came up before this Court, the learned counsel appearing for the petitioner submits that the liberty may be granted to approach the Debt Recovery Tribunal.
