By way of the present petition filed under Article 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioner seeks quashing of FIR No. 25/2024, registered at Cyber Police Station, Outer North, Delhi, for the offence punishable under Section 420 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State.
4. The petitioner is present before this Court. Respondent no. 2 who is present through video conferencing has been identified by his counsel and the Investigating Officer concerned.

Brief facts of the case are that the present FIR came to be registered on the complaint of respondent No. 2 alleging that he was defrauded of an amount of Rs. 17,224/- through an online financial transaction. The said amount was transferred through UPI pursuant to representations allegedly made by unknown persons regarding his insurance policy. 6. During the pendency of the proceedings, the parties amicably resolved their disputes. The petitioner has returned the entire disputed amount of Rs. 17,224/- to respondent No. 2 and the parties have entered into a Compromise/Settlement Deed dated 18.12.2025. 7. On a query made by this Court, respondent No. 2, who has been identified by the Investigating Officer, has categorically stated that the settlement has been entered into by him out of his own free will and without any pressure, coercion or undue influence. He further states that he has received the entire settled amount and has no objection if the present FIR and the proceedings emanating therefrom are quashed. 8. In view of the aforesaid settlement between the parties, the nature of the dispute, the fact that the entire amount has been repaid to respondent No. 2 and the statement made by respondent No. 2 before this Court, no useful purpose would be served by continuing the criminal proceedings. Continuation of the proceedings would, in the facts and circumstances of the present case, amount to an abuse of the process of law. It would thus be in the interest of justice to quash the FIR and the proceedings emanating therefrom. This is a digitally signed order. Accordingly, FIR No. 25/2024, registered at Cyber Police Station, Outer North, Delhi, for the offence punishable under Section 420 of the IPC, along with all consequential proceedings emanating therefrom, is hereby quashed. 10. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 11. Copy of the order be communicated to the concerned Trial Court for necessary action and compliance. 12. The order be uploaded on the website forthwith.
