Applicant seeks interim bail for a period of 45 days in order to enable him to take MBBS Second Professional Regular (University Examination) Batch-2024-2025 which commences from 01.09.2026. Theory examinations are, reportedly from 01st to 11th September, 2026, followed by Practical Examination which is to be conducted within 20 days thereafter. 2. Admittedly, earlier also, applicant had prayed for interim bail in order to take Qualifying Pre University Examination. This Court, while This is a digitally signed order. It was also directed that after his such examination was over, he would surrender and thereafter, he would be at liberty to file fresh application before this Court in case he is required to appear in the Main Examination. 3. Affidavit has been filed, which is taken on record. As per affidavit, applicant has cleared Pre-University Qualifying Examination and is eligible to sit in the Second Semester Main Examination. He has also been issued an Admit Card, copy of which has also been annexed with the affidavit. He has been able to clear such qualifying examination as would be evident from the copy of Mark-Sheet which has been placed on record. 4. Application has been opposed by learned Addl. P.P. for State/R-1 as well as by learned counsel for complainant/R-2 for the reason that allegations are serious in nature. 5. Fact, however, remains that earlier, this Court had granted indulgence to the applicant and there is nothing on record which may indicate that he had misused the aforesaid liberty or concession. 6. Keeping in mind the overall facts of the case and for the reason already recorded by this Court in its order dated 24.07.2026, the applicant is granted interim bail till 05.10.2026 so as to enable him to appear in the aforesaid examination on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of the like amount subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:- (i) Surety would be local. (iii)In case, any such instance is brought to the notice of the Court by the prosecution, the order would be recalled, without any further notice. (iv) On expiry of period of interim bail, applicant shall surrender before the Jail immediately. 7. It is also clarified that if Practical Examination is conducted much prior to the aforesaid date of surrender i.e. 05.10.2026, the applicant would not wait till 05.10.2026 and would surrender within two days of his Practical Examination. 8. The application stands disposed of in aforesaid terms. 9. A copy of this Order be sent to the learned Trial Court and Jail Superintendent for information and necessary compliance. 10.
