Sahibganj. … Respondents. ------- CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Gautam Kumar Singh, Advocate For the Respondents : Mr. Mohan Dubey, AC to AG ------ 07/ 11.06.2026: The petitioners in this writ petition have prayed for following relief: “(i) For calling for record containing information regarding establishment of the Manti Bewa Middle School, Mangalhat situated Mangalhat, P.O. Mangalhat, P.S. Rajmahal. Distt. Sahibganj, now named as Utkramit +2 Uccha Vidyalay, Mangalhat as no information is being provided to the petitioners by the respondent authorities concerned regarding the change of name of the aforesaid school; (ii) For show cause to the respondents as to why and how the name of the aforesaid school has been changed quite contrary to the terms and the gift deed executed by the donor, viz., Manti Bewa in favour of the donee to the then Governor of the State of Bihar (now Jharkhand) through the then Block Development Officer (B.D.O.), Rajmahal, Santhal Paragana for the purpose of opening and running the school in her name as Manti Bewa Middle School, Mangalhat; (iii) Directing the respondents to restore the name of the aforesaid school as it stood at the time of its establishment with suitable adjustments in the light of its elevation to the +2 High School presently; (iv) Directing the respondents, especially the respondent no. i.e., the Block Development Officer (B.D.O.), Rajmahal to get the plot of land situated in Mouza Mahasingpur, J.B. No. 11, Daag No. 806 admeasuring a total area of 03 bigha-15 kattha-12 dhurs mutated in the name of the Govt. of Jharkhand which was gifted/transferred by Manti Bewa to the Govt. for the purpose of running and maintaining the aforesaid school; (v) For restraining the respondent authorities concerned from demolishing the building of the aforesaid school;” 2. Heard the learned counsel for the petitioners and the learned counsel for the respondent-State. 3. Counsel for the petitioners submits that the petitioners are the grandsons of Manti Bewa. A Middle School was constructed over the land of Manti Bewa and the same was named as Manti Bewa Middle School at Mangalhat. Subsequently, said Manti Bewa donated the land to the Government for the purpose of construction of school. The Middle School, later on, was upgraded by the State Government and the name has been changed to Utkramit +2 Uccha Vidyalay, Mangalhat (Upgraded +2 High School, Mangalhat. 4. It is the grievance of the petitioners that the name of their grandmother has been removed, which hurts the sentiment of the petitioners. It is their contention that the name of Manti Bewa should be incorporated in the name of the School as the land has been donated by their grandmother. 5. Counsel for the State submits that all the Middle Schoos, which have been upgraded as +2 High Schools, have been renamed to keep uniformity as Utkramit +2 Uccha Vidyalay (Upgraded +2 High School). 6. After going through the records, I find that it is an admitted case that the land has been gifted to the State of Bihar for the purpose of School by Manti Bewa, the document of which is on record. There is nothing in the gift deed nor there was any assurance that the School will be named on the name of Manti Bewa. Thus, the petitioners cannot make any claim to change the name of the School. 7. So far as the sentiments of the petitioners, who happens to be the legal heirs of Manti Devi are concerned, the respondent authorities, if so advised, may affix a board in the premises of the School indicating that the land has been donated by Manti Bewa. 8.
