Counsel for petitioners, after arguing for some time, seeks to withdraw this petition to assail the order/action of the department/railways in directing the petitioners to participate in Physical Efficiency Test (PET). 2. The liberty is prayed for because such prayer could not have been made in a contempt petition and therefore, it is prayed that permission can be granted to file original application. 3. In our opinion, such a liberty was already granted by learned tribunal in the 2 impugned order dated 19.04.2024 passed in C.P./128/2023 (Kolkata). 4. Other side has no objection. 5. The petition is dismissed as withdrawn with the liberty, as prayed for. 6.
