(At Present Confined In Central Jail Jaipur). ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Vikash Kumar Jakhar For Respondent(s) : Mr. Rhishi Raj Singh Rathore PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 06/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.23/2026 registered at Police Station Shahpura (Jaipur Rural), District Jaipur Rural for offence(s) under Section(s) 8/21 of NDPS Act. 2. Learned counsel for the petitioner submits that the accused-petitioner is an innocent person and has been falsely implicated in this case. Learned counsel further submits that the contraband allegedly recovered from the petitioner is below commercial quantity. Counsel also submits that co-accused namely, Sonu Nayak has already been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 24.01.2026 passed in S. B. Criminal Misc. Bail Application No.1389/2026. He further submits that the petitioner has no criminal antecedent; he is in custody since long and no recovery is required to be made [2026:RJ-JP:5733] (2 of 3) [CRLMB-1867/2026] from him. As the conclusion of trial will take considerable time, so no fruitful purpose would be served by keeping the petitioner in custody, therefore prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor opposes the bail application. 4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that the co-accused has already been enlarged on bail, the contraband recovered from the petitioner is below commercial quantity and the petitioner has no criminal antecedent, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application is allowed and accused-petitioner Teekaram Gurjar S/o Banshidhar Gurjar is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the following conditions:- (i) The accused-petitioner shall not tamper with evidence or influence the witness in any manner.
