[2026:JHHC:17046] IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr.M.P. No.1615 of 2026 ------ Rahul Mishra, aged about 30 years, S/o Late Naresh Mishra, resident of Joganiyatand, P.O. & P.S.- Ahilyapur, District- Giridih … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Ms. Neha Bhardwaj, Advocate For the State : Mr. Nawin Kr. Singh, Addl. P.P. ------ Order No:-02 Dated:-12-06-2026 Heard the parties. This criminal miscellaneous petition has been filed by the petitioner with the prayer to modify/relax the bail condition imposed by a co-ordinate Bench of this Court vide order dated 10.02.2026 passed in B.A. No.11901 of 2025. The allegation against the petitioner is that the petitioner has committed the offences punishable under Section 303 (2), 317 (2), 317 (3), 317 (5) and 3 (5) of the B.N.S., 2023. The petitioner has committed theft of a motorcycle which was seized from his house. So, it goes to show that the petitioner has a house and he was in possession of a motorcycle. He has been admitted to bail on furnishing bail bond of Rs.25,000/- with two sureties. Learned counsel for the petitioner submits that due to acute financial hardship and lack of solvent sureties, the petitioner is unable to comply the said condition and continues to remain in jail custody despite grant of bail. Learned counsel for the petitioner further submits that she is unaware as to what is the educational qualification of the petitioner, whether he earned any money by working in the jail, what is it is profession and who are the other family members of the petitioners but the undisputed fact remains that the petitioner is having a house. It is needless to mention that for furnishing a bail bond, no money is required. Under such circumstances, this court has no hesitation in holding that as the petitioner has not come to Court with clean hands, this Court is not inclined to modify/relax the bail condition imposed by a co-ordinate Bench of this Court vide order dated 10.02.2026 passed in B.A. No.11901 of 2025. Accordingly, this criminal miscellaneous petition, being without any merit, is dismissed. (Anil Kumar Choudhary, J.) Dated-12.06.2026-Animesh/
