JUSTICE AMIT SHARMA O R D E R % 24.08.2026 1. The present petition has been filed under Articles 226/227 of the Constitution of India, seeking setting aside of impugned order dated 13th April, 2023 passed by Armed Forces Tribunal in Original Application No. 920/2023. 2. Apart from there being a delay of more than three years, as the impugned order was passed on 13th April, 2023 and the present petition has been preferred in 2026, in response to the Court’s query, it is informed that the order passed by the Armed Forces Tribunal has already been implemented. 3. Apart from above, the order of the Armed Forces Tribunal is based on the judgments of Hon’ble High Court of Guwahati and other judgments of co- ordinate Tribunal as referred in paragraph 5 and 6 of the impugned order. In that view of the matter, we are unable to agree with the contention raised by learned counsel for the petitioners that on account of an interim order operating in a pending matter, which is likely to be heard in the near future, this Court should entertain the present petition. 5. Be that as it may, in our opinion, no case is made out for causing interference in the extraordinary jurisdiction. 6. The present petition is dismissed. 7. Pending application(s), if any, also stands disposed of. 8. Order be uploaded on the website of this Court, forthwith.
