The petitioner is a part time NCC Clerk employed since June 1999 in the Vidyasagar College. The petitioner had approached this Hon’ble Court on earlier occasions and armed with orders, has been receiving payment at the rate Rs. 8167/- since September 20, 2023. 2. The petitioner’s grievance is that this enhanced amount is payable to him from June 1, 2009 or even at the very best since September 2011. The petitioner has relied on the Memorandum of the Finance Department no. 9008-F(P) dated September 16, 2011 to urge that the petitioner is squarely covered by such memo and, therefore, entitled to enhanced payment from September 20, 2011, though this issue was raised in the earlier writ petition being WP 6156(W) of 2019, the same had 2 not been considered though, the same had been reserved by the order passed in CPAN 422 of 2024 on December 5, 2025 in favour of the petitioner. 3. Pursuant to the reservation made in the afore-stated order, the petitioner made representations on December 16, 2025 and December 17, 2025, which have not yet been considered. 4. In view of the fact that such a right had been reserved, the notification of November 11, 2025 issued by the respondent authorities bearing no. 213L/1C-152L/2019 cannot be construed as a final determination of the petitioner’s right to obtain enhanced payment. 5. Since the petitioner is going to retire on March 31, 2026, I direct the respondent no. 3 to consider the representation of the petitioner dated December 16, 2025 in accordance with law. The said representation will be considered and disposed of after giving a hearing to the petitioner by March 15, 2026. 6. The petitioner will be at liberty to produce all necessary documents to further his case that he is entitled to enhanced payment from June 1, 2009. 7. The process of consideration upon being completed will be intimated to the petitioner by March 20. 2026. 8. With these afore-stated directions, the writ petition 3 is disposed of. 9. There shall, however, be no order as to costs. 10. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
