( 2026:JHHC:17087 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 5176 of 2026
------ Arvind Kumar Mehta, S/o Govind Prasad Mehta @ Govind Prasad, aged about 29 years, resident of Village –Asiya, P.O. & P.S. –Ichak, District –Hazaribag.
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Jitesh Kumar, Advocate For the State
: Mr. Vishwanath Roy, Spl. P.P. ------
Order No.02 Dated- 12.06.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. Case No. 256 of 2025 arising out of Ichak P.S. Case No.137 of 2024 registered for the offences punishable under sections 103(1) of the B.N.S., 2023.
This is the second journey of the petitioner with the prayer for regular bail. Earlier the prayer for regular bail of the petitioner was rejected on merit vide order dated 24.06.2025 in B.A. No. 4933 of
2025. It is submitted by the learned counsel for the petitioner that the fresh ground is that so far three witnesses have been examined out of which P.W.3 has become hostile and has not supported the case of the prosecution and P.W.1 is the eye-witnesses of the occurrence who has supported the case of the prosecution and P.W.2 who is a post-occurrence witness has also supported the case of the prosecution. Hence, it is submitted that the petitioner be admitted to bail.
The learned Spl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the overwhelming evidence that has already come on record through the P.W.1 who is the eye-witness to the occurrence and who has categorically stated that the petitioner has committed murder of Rahul Kumar Mehta, there is every chance of the petitioner
absconding and tampering with the evidence if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner and the evidence that has already come on record through the witnesses examined, this Court is not inclined to admit the petitioner on bail at this stage.
Accordingly, the prayer for regular bail of the above-named petitioner is rejected.
