JUSTICE SOUMITRA SAIKIA ORDER 13.10.2026 Heard the learned counsel for the applicant. 2] This interlocutory applicant has been filed by the applicant under Order XXII Rule 3 R/W Section 151 of CPC seeking substitution as the authorized legal heir of the petitioner namely late Sahidur Rahman in WP(C) No.4984/2025. The petitioner in WP(C) No.4984/2025 has four children. The applicant namely Anisur Rahman @Anisur Rahaman is the son of the said petitioner and he has three daughters. The daughters of the said petitioner have executed No Objection Certificate on 03.07.2026. Under such circumstances, this interlocutory application has been filed by the applicant seeking substitution and inclusion as sole legal heir of the said petitioner. 3] The learned counsel for the respondents do not raise any objection. 4] Accordingly, this interlocutory application stands allowed in the face of NOC stated to have been executed by the other legal heirs of the petitioner Page No.# 3/3 namely Sahidur Rahman, who are his daughters and the applicant namely Anisur Rahman @Anisur Rahaman is substituted as sole legal heir in place of the writ petitioner namely Sahidur Rahman who had expired during the pendency of the writ petition. 5] This application stands disposed of. 6] The petitioner will file amended cause title before the Registry within a period of one week from today.
