The instant criminal miscellaneous application under Section 482 Cr.P.C./528 of BNSS has been preferred for quashing of the cognizance order dated 05.09.2023 and the charge-sheet dated 03.08.2023 and quashing of the entire proceedings of Criminal Case No.1443 of 2023 (FIR No.64 of 2023), State vs. Sumer Kaushik and others, under Sections 420, 467, 468, 471, 120B & 506 of IPC, Police Station I.T.I., Udham Singh Nagar. 5. The criminal miscellaneous application is also accompanied by the compounding application. The applicant nos.1, 2 and 3 are present in person and applicant no.4 is in jail. Respondent nos.2 and 3 are present in person duly identified by their counsel Mr. Abhishek Verma. 6. On an interaction, respondent nos.2 and 3 have stated before this Court that they have received the amount of money which was taken from them by cheating by the applicants and they do not wish to pursue the matter any further. 7. In that view of the matter, the compounding application (IA No.2 of 2026) is allowed. The cognizance order dated 05.09.2023 (Annexure-3) and charge-sheet dated 03.08.2023 (Annexure-2) and the entire proceedings of Criminal Case No.1443 of 2023 (FIR No.64 of 2023), State vs. Sumer Kaushik and others, under Sections 420, 467, 468, 471, 120B & 506 of IPC, Police Station I.T.I., Udham Singh Nagar, pending in the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar qua the applicants are hereby quashed. 8. Let the applicant no.4 be released forthwith, if he is not required in any other case. 9. The Criminal Miscellaneous Application and the Urgency Application (IA No.1 of 2026) stand disposed of accordingly. 10. Registry is directed to forward the order to the jail authority.
