JUSTICE H.T. NARENDRA PRASAD ORAL ORDER 1. In this writ petition, the petitioner-defendant No.1 has sought for a direction to the I Addl. Senior Civil Judge, Bengaluru Rural District, Bengaluru (for short ‘Trial Court’), to dispose of O.S.No.1174/2020 expeditiously within a period of three months. 2. For the sake of convenience, the parties are referred to as per their ranking before the Trial Court in Original Suit. 3. The plaintiff filed a suit in O.S.No.1174/2020 before the Trial Court seeking for relief of partition and separate possession. After issuance of suit summons, the defendants appeared and filed written statement. On the basis of the pleadings of the parties, the Trial Court has framed issues and the matter is set down for recording the - 4 - HC-KAR NC: 2026:KHC:23460 WP No. 13488 of 2026 evidence of the parties. The plaintiff’s evidence has been completed and the evidence of defendants has been partly completed. The suit is of the year 2020. Therefore, the present writ petition is filed seeking for early disposal of the suit. 4. Learned counsel appearing for the petitioner submits that in the earlier round of litigation in MFA No.4694/2022 disposed on 17.03.2023, this Court had directed the Trial Court to dispose of the suit as expeditiously as possible, not later than an outer limit of nine months from the date of receipt of copy of this order. So far, the suit is not disposed of. Hence, he sought for a direction to the Trial Court to dispose of the suit within a fixed time frame. 5. Having regard to the facts and circumstances of the case, and without expressing any opinion on the merits of the matter, this Court deems it appropriate to dispose of - 5 - HC-KAR NC: 2026:KHC:23460 WP No. 13488 of 2026 the writ petition with a direction to the Trial Court to dispose of the suit as expeditiously as possible. 6. Accordingly, the following order is passed: ORDER a) The writ petition is disposed of. b) The Trial Court is directed to dispose of the suit in accordance with law and as expeditiously as possible, not later than four months from the date of receipt of certified copy of this order, provided there is no order of stay of the said proceedings granted by any Court of law. c) Parties are directed to co-operate for early disposal of the suit.
