PATIL - 3 - HC-KAR NC: 2026:KHC:10462-DB CCC No. 958 of 2024 ORAL ORDER (PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL) 1. This contempt petition is filed alleging willful disobedience of the order dated 19.07.2024 passed in W.P.No.10383/2024. The operative portion of the order reads as under; "11. In the result the following; ORDER (1) Petition is hereby allowed. (ii) The impugned Endorsement at Annexure- A dated 22.03.2024 is hereby quashed. (iii) The 1st respondent-Sub Registrar is directed to register the sale certificate at Annexure-B dated 20.03.2024 executed by respondent No.3 within a period of two weeks from the date of receipt of a copy of this order. (iv) Alternatively, in the event the petitioners do not pay the requisite stamp duty on the sale certificate, the 1st respondent Sub-Registrar is directed to make an Entry of the Sale Certificate dated 20.03.2024 in favour of the petitioners in Book No.1 and in all - 4 - HC-KAR NC: 2026:KHC:10462-DB CCC No. 958 of 2024 official records by filing a copy within a period of two weeks from the date of receipt of a copy of this order. (v) It is made clear that all acts, deeds and things done by the parties pursuant to the present order shall be subject to final outcome of T.S.A.No.5/2024 and W.P.No.19356/2019 and all rival contentions on all aspects of the matter are kept open and no opinion is expressed on the same. (vi) Liberty is reserved in favour of the 2nd respondent - ED to take necessary steps in accordance with law. (vii) By way of an interim arrangement, the petitioners are directed not to alienate the subject property for a period of three months from today." 2. The learned Additional Government Advocate appearing for the accused submits that the affidavits are filed on 30.11.2024 and 26.11.2025. The said affidavits clearly indicate that the complainant has not paid the stamp duty as ordered. Hence, the second portion of the - 5 - HC-KAR NC: 2026:KHC:10462-DB CCC No. 958 of 2024 order to enter the sale certificate in book No.1 has been complied as evident from Annexure-R1. 3. Learned counsel for the complainant disputes the same and states that the sale consideration is not reflected in E.C. We are not agreeing with the said submission as there is no such direction in the order of the learned Single Judge. Hence, contempt proceedings are dropped as there is no willful disobedience of the order of the learned Single Judge. 4. Notice issued to the accused shall stand discharged. 5.
