JUSTICE SAMEER JAIN Order 23/03/2026 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-applicants. The accused-applicants were arrested in connection with FIR No. 205/2025 registered at Police Station Virat Nagar District Kotputli-Behror for the offence(s) under Sections 8, 21 of the NDPS Act and the learned [2026:RJ-JP:12168] (2 of 3) [CRLMB-2743/2026] Trial Court amidst the offences under Sections 8/29 of the NDPS Act dismissed the bail applications before it. 2. Learned counsel for the accused-applicants submits that primary recovery of the contraband Tramadol Capsules has been made from the co-accused, namely Dharmveer @ Mahodav and Lakhan, who have already been enlarged on bail by the Co- ordinate Bench of this Court vide order dated 31.10.2025 in S.B. Criminal Miscellaneous Bail Application No. 13118/2025. It is further submitted that the case of the applicants is on same pedestal as that of the co-accused. 3. Per contra, learned Public Prosecutor has vehemently opposed the present bail application. 4. Having heard the contentions made by the learned counsel for the parties, upon a perusal of the material available on record and taking note of the fact that primary recovery of the contraband has been made from the co-accused, namely Dharmveer @ Mahodav and Lakhan, who have already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 31.10.2025; that prima facie it appears that the case of the applicants is on same pedestal as that of the co-accused, and looking to the overall facts and circumstances but without commenting upon the merits/demerits of the case, this Court is inclined to enlarge the accused-applicants on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicants Dilip Kumar Verma S/o Shri Moolchand and Rinku Yadav S/o Tejram shall be enlarged on bail provided they furnishes a personal bond of Rs.50,000/- each with two sureties of Rs.25,000/- each to the [2026:RJ-JP:12168] (3 of 3) [CRLMB-2743/2026] satisfaction of learned trial Judge for his appearance before the Court concerned on all the dates of hearing as and when called upon to do so.
