The petitioners-tenants are before this Court challenging the order of eviction dated 23.07.2025 passed in H.R.C.No.22/2019. 3. Learned counsel for the caveator/respondent- landlord submits that before the Executing Court, the present - 3 - HC-KAR NC: 2026:KHC:14738 HRRP No. 20 of 2025 petitioner had undertaken to vacate the premises by 13.03.2026, as such, the petition has to be dismissed. 4. Learned counsel for the petitioners-tenants submits that the petitioners are shifting to a new premises. However, the new premises is not completely ready and it will be ready by 31.05.2026 and before the said date, the petition premises would be handed over to the respondent-landlord. 5. The said submission is placed on record. ORDER (i) The petition is dismissed based on the submission. (ii) The petitioners shall handover possession of the petition premises before 31.05.2026. (iii) In case, for any reason, the possession is not handed over by the petitioners, the Executing Court shall issue delivery warrant with police aid for execution of the order. (iv) The petitioners shall also pay the rent until the date of their occupation, and said occupation shall not be beyond 31.05.2026. - 4 - HC-KAR NC: 2026:KHC:14738 HRRP No. 20 of 2025 (v) Pending applications, if any, do not survive for consideration.
